These Terms and Conditions (“Terms”) govern your use of our website at ubapressurewashing.com and the services provided by Pressure Washing By Yoder LLC, doing business as UBA Pressure Washing & Sealer (“UBA,” “we,” “us,” or “our”). By visiting our website, requesting a quote, scheduling a service, or otherwise engaging with us, you agree to these Terms. If you do not agree with any part of these Terms, please do not use our website or our services.
Acceptance of Terms
These Terms form a binding agreement between you and Pressure Washing By Yoder LLC. By submitting a contact form, requesting an estimate, signing a service proposal, or paying a deposit, you confirm that you are at least 18 years old, that you have the legal authority to enter into this agreement, and that you have read, understood, and agreed to these Terms.
We may update these Terms from time to time. The “Effective Date” at the top of this page indicates when the current version went into effect. Continued use of our website or services after an update means you accept the updated Terms.
Services Provided
UBA Pressure Washing & Sealer is a Florida-licensed exterior cleaning and sealing company specializing in residential and commercial pressure washing services. Our services include but are not limited to:
Roof soft washing, HydroLock roof sealing, mold power treatment, paver cleaning and sealing, specialty stone sealing (marble, travertine, shell lock), house washing (exterior soft washing), pool cage cleaning and UV ray compound application, and related exterior cleaning services.
Each service is performed in accordance with the written estimate or proposal you receive and sign. Our work is governed by industry best practices, manufacturer specifications for the chemicals and sealers we use, and the operating procedures developed by Josh Yoder over 15 years in the roofing and exterior cleaning industries.
Estimates, Proposals, and Scope of Work
All estimates are valid for 30 days from the date issued unless otherwise stated in writing. The estimate describes the scope of work to be performed, the property to be treated, the chemicals or sealers to be applied, and the price.
Any work outside the original scope, including additional surfaces, additional buildings, repairs to pre-existing damage, or changes requested after work has begun, requires a written change order signed by you before that additional work is performed.
We reserve the right to revise an estimate after on-site inspection if the actual property conditions differ materially from what was described during the initial inquiry (for example, undisclosed roof damage, larger square footage than reported, restricted access, or hazardous conditions).
Payment Terms
Deposit
Most services require a deposit to schedule and reserve crew time. The deposit amount is specified in your written estimate or proposal. The deposit secures your appointment, covers initial material costs, and is applied to your final invoice.
Balance Due
The remaining balance is due upon completion of the work unless a different payment schedule is specified in writing in your signed proposal. Payment is accepted by major credit card, debit card, ACH transfer, or check made payable to Pressure Washing By Yoder LLC.
Late Payments
Invoices not paid within 15 days of completion may be subject to a late fee of 1.5% per month (18% per year), to the extent permitted by Florida law. If an account becomes delinquent, you agree to pay all reasonable costs of collection, including court costs and attorneys’ fees.
Returned Payments
Returned checks or failed ACH transfers will be subject to a $35 returned-payment fee in addition to any fees charged by the financial institution.
Scheduling, Rescheduling, and Cancellation
Scheduling
Service dates are scheduled based on crew availability, weather conditions, and the order in which deposits are received. We will provide an arrival window in advance and confirm the day before service whenever possible.
Weather Delays
Florida weather is unpredictable, and many of our services cannot be performed safely or effectively in heavy rain, high wind, or lightning. If weather requires rescheduling, we will contact you as soon as possible to arrange a new date. Weather-related rescheduling is not a cancellation and does not affect your deposit.
Rescheduling by Customer
If you need to reschedule your appointment, please notify us at least 48 hours before your scheduled service date. Rescheduling within 48 hours of service may be subject to a rescheduling fee depending on crew commitments.
Cancellation by Customer
You may cancel a scheduled service in writing at any time. If you cancel more than 7 days before the scheduled service date, your deposit will be refunded in full. If you cancel within 7 days of the scheduled service date, the deposit is non-refundable to cover crew scheduling, material ordering, and lost opportunity costs. If work has already begun, you are responsible for the full cost of work performed plus the value of materials already applied.
Cancellation by UBA
We reserve the right to cancel or reschedule any service due to unsafe property conditions, undisclosed hazards, severe weather, equipment failure, illness, or other circumstances outside our control. In the event we cancel a service before any work has been performed, your deposit will be refunded in full.
Property Access and Site Conditions
You are responsible for providing safe and clear access to the property and the surfaces to be cleaned or sealed. This includes:
Removing or relocating outdoor furniture, planters, vehicles, grills, and other obstructions from work zones.
Closing and securing all windows and exterior doors before service begins.
Disconnecting downspout extensions where applicable.
Notifying us in writing of any underground irrigation, low-voltage wiring, lighting, electrical components, or other property features that may be affected by water or chemical contact.
Notifying us in writing of any prior treatments, sealers, coatings, or repairs performed on the surfaces we will be treating, and providing documentation if available.
Notifying us of any pets or animals on the property and securing them indoors during service.
Notifying us of any HOA, condominium association, or municipal restrictions that apply to the work.
Limitation of Liability
Pressure Washing By Yoder LLC carries general liability insurance and workers’ compensation coverage. Proof of insurance is available upon request. While we take every reasonable precaution to protect your property, certain risks are inherent in exterior cleaning and sealing work. The following limitations apply:
Pre-Existing Damage
We are not responsible for damage that existed before our service began, including but not limited to broken or cracked roof tiles, loose or missing tiles, deteriorated or improperly installed underlayment, rotted wood, faulty flashing, failing caulking, broken or detached gutters, damaged screen enclosures, deteriorated paint or stain, cracked pavers, deteriorated grout, or any condition disclosed or undisclosed at the time of inspection. We document property conditions before work begins where possible. If pre-existing damage becomes apparent during cleaning, we will notify you promptly so you can arrange repairs with a qualified contractor.
Roof Tile Cracking and Brittleness
Florida roof tiles, especially older tiles or tiles that have been subjected to improper prior maintenance (such as high-pressure washing, walking by untrained contractors, or pressure-injected coatings), become brittle and may crack under any contact. Tiles can crack from foot traffic, expansion and contraction, settling, prior installation defects, and age. While our crews use proper roof-walking techniques and the gentle soft-wash method (low pressure, properly diluted chemistry), we cannot guarantee that brittle, pre-damaged, or improperly maintained tiles will not crack during the course of normal service. We are not liable for the cost of replacing tiles that crack due to pre-existing brittleness, prior improper maintenance, age, or manufacturing defects.
Soft Wash Chemistry
Our soft-wash chemistry is industry standard and properly diluted to safely remove biological growth from roofs, siding, screens, and other surfaces. We use clean water rinses and plant protection where applicable. We are not liable for damage to landscaping, lawns, plants, or other vegetation that occurs despite reasonable precautions, including but not limited to plant sensitivity to sodium hypochlorite, plants showing distress days or weeks after service, or plants that were already in declining health.
Painted, Stained, and Coated Surfaces
Pressure washing and soft washing can affect painted, stained, or coated surfaces that are already failing, peeling, chalking, or improperly applied. We are not liable for the failure or removal of compromised paint, stain, or coatings. If you have concerns about a painted surface, please notify us before service so we can adjust our approach or recommend an alternative.
Maximum Liability
To the maximum extent permitted by Florida law, our total liability for any claim arising out of or related to our services is limited to the amount actually paid by you for the specific service that gave rise to the claim. Under no circumstances shall UBA, its owners, officers, employees, or subcontractors be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of use, loss of property value, loss of business, or emotional distress.
Force Majeure
We are not liable for delays, damages, or failure to perform caused by events beyond our reasonable control, including but not limited to hurricanes, tropical storms, flooding, lightning, wildfires, government orders, supply chain disruptions, labor disputes, or pandemics.
Warranties and Guarantees
Specific warranties for HydroLock roof sealing and other services are described in the written estimate or proposal you receive and in any separate warranty document we provide. Generally, our HydroLock roof sealing service includes a 5-year no-growth guarantee with terms and conditions set forth in the HydroLock warranty document.
Except for warranties stated in writing in your signed proposal or in a separate warranty document, we disclaim all other warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
Warranty claims must be submitted in writing to [email protected] within the warranty period and must include the original service date, a description of the issue, and photographs documenting the condition. We will respond to warranty claims within 30 days of receipt.
Warranties are voided by any of the following: failure to follow recommended maintenance, use of unauthorized chemicals or cleaners on treated surfaces, alteration or modification of the treated surface by another contractor, removal or repair of the underlying surface, transfer of property ownership without prior written notice to UBA, or non-payment of any invoice owed to UBA.
Intellectual Property
All content on ubapressurewashing.com, including text, graphics, logos, photographs, videos, software, and the overall design and layout, is the property of Pressure Washing By Yoder LLC or our licensors and is protected by United States copyright, trademark, and other intellectual property laws.
Trademarks
HydroLock is a trademark of Pressure Washing By Yoder LLC. UBA Pressure Washing & Sealer, the UBA logo, and other UBA marks are trademarks of Pressure Washing By Yoder LLC. You may not use any UBA trademark without our prior written permission.
Limited License to Use Website
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use ubapressurewashing.com for personal, non-commercial purposes related to evaluating or engaging our services. You may not reproduce, distribute, modify, create derivative works of, publicly display, publish, or sell any portion of our website without our prior written consent. You may not use any automated means to scrape, harvest, or collect data from our website.
Customer Testimonials and Photos
By providing a review, testimonial, photograph, or video to UBA, you grant us a perpetual, royalty-free, worldwide license to use that content on our website, in marketing materials, and on social media for promotional purposes. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms, our services, or our website shall be brought exclusively in the state or federal courts located in Sarasota County, Florida, and you consent to the personal jurisdiction of those courts.
Dispute Resolution
Before filing any lawsuit, you agree to first contact us in writing at [email protected] with a detailed description of the dispute. We will work with you in good faith for at least 30 days to resolve the dispute informally. If we cannot resolve the dispute informally, either party may pursue formal legal remedies in accordance with the Governing Law and Jurisdiction section above.
Either party may, but is not required to, propose mediation through a Florida-based mediator before initiating litigation. The cost of mediation, if agreed to, will be shared equally between the parties unless otherwise agreed in writing.
Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be severed from these Terms and the remaining provisions shall remain in full force and effect.
No Waiver
Our failure to enforce any provision of these Terms shall not be considered a waiver of that provision or of our right to enforce it later.
Entire Agreement
These Terms, together with our Privacy Policy, your signed estimate or proposal, and any separate warranty documents we provide, constitute the entire agreement between you and Pressure Washing By Yoder LLC regarding your use of our website and our services, and supersede any prior or contemporaneous agreements, communications, or representations.
